SUMMARY:Bankruptcy 101: An Introduction to Dealing with Parties Who Just Can’t/Won’t Pay
DESCRIPTION:You may never have thought of yourself as needing to learn bankruptcy law\, but if you work on any issue that involves making someone do something they don’t want to do or pay money they don’t want to pay\, you need to know about bankruptcy law. \nThis includes: \n\nEnforcing consumer or environmental protection laws.\nCollecting taxes.\nEnforcing child support payments.\nWorking on state contracts.\nProsecuting people who collect benefits they’re not entitled to.\n\nThere are a lot of individuals out there that think that filing bankruptcy is a way to avoid those obligations and\, if you are to be an effective representative of the state and the order and judgments it issues\, you’ll need to know just how far that bankruptcy relief extends. \nThe good news is that there are a lot of ways the bankruptcy laws do accommodate and give priority to governmental enforcers but there are also a lot of limits and controls on what the government can do while it is enforcing its rights. The goal of this series is to provide an introduction and overview of bankruptcy law for all governmental counsel. \n\n\n\n Date\n Session Topic\n\n\n July 1\n Introduction and Overview\n\n\n July 8\n Automatic Stay\n\n\n July 15\n Claims\n\n\n July 22\n Discharge\n\n\n July 29\n Operations During the Case\n\n\n\nEach session will be recorded and the recordings will be available after the completion of the series\, but we would urge you to attend the live sessions so we can ensure that we cover all the areas that staff are interested in hearing about and making sure that we get their questions answered. \nSpeakers\n\nKaren Cordry\, NAAG Bankruptcy and State Defensive Litigation Chief Counsel\nPatricia Molteni\, NAAG Tobacco Center Counsel\n\nRegistration\nThis webinar is free and open to the public. SUMMARY:The New Small Business Bankruptcy Chapter - Timely Help in a Time of Crisis
DESCRIPTION:This webinar is hosted by NAAG and the Association of Topeka Area Bankruptcy Counsel. \nJune 23\, 2021 at 1:00 P.M. – 2:15 P.M. ET \nThis program will provide an overview of the new small business provisions in Chapter 11 bankruptcy. The Subchapter V language was enacted in 2019 just in time to be available for the onset of the COVID crisis. It was originally limited to businesses with less than $2.5 million in debt\, but that was temporarily expanded after COVID to $7.5 million. The provisions are meant to provide a simplified process for these small debtors so that those with debt limits above what can be handled in Chapter 13 can still benefit from a similar approach. \nThus far\, the chapter has proven to be highly popular and\, as the debt deferral provisions relating to COVID begin to ratchet down\, it will likely prove even more important in upcoming months. This program will provide an introduction to practice and procedure in these cases based on materials presented by Judge Eduardo Rodriguez of the U.S. Bankruptcy Court from the Southern District of Texas. \nSpeakers\n\nJudge Eduardo Rodriguez\, Southern District of Texas’ U.S. Bankruptcy Court\n\nRegistration\nThis webinar is free and open to the public. If you have any questions\, please contact Emily Parsons at eparsons@naag.org. \nRegistration deadline is Wednesday\, June 23 at noon ET. \nIf you have created your NAAG account and receive an error message when trying to register\, please make sure you have entered your organization under your profile. You may need to wait up to 24 hours after your account is verified by your office before being able to register for this webinar. \nCLE Credit\nNAAG will apply for CLE for attendees eligible under CLE accrediting body guidelines.
