SUMMARY:AGO Staff Only Webinar (Dec. 13)
DESCRIPTION:This webinar is a closed session for attorneys general and attorney general staff only. Please login to view the full event information. \n_______________________________________________________________ \nNew IRS Reporting Requirements Regarding Government Settlements/Judgments: Tips for Complying with the New Regulations\nTuesday\, Dec. 13\, 2022 at 3:00 p.m. – 4:15 p.m. ET\nHosted by the NAGTRI Center for Consumer Protection \n\nFederal law was amended in 2017 to change how money paid to the government as part of a penalty or settlement is treated for tax purposes. Previously\, those payments were generally deductible. As of Jan. 1\, 2018\, those payments are not deductible unless they are for purposes of restitution\, remediation\, or costs to come into compliance with the law. Federal law was also amended to require that government entities report payments received from private parties to the IRS if those payments were\, in general\, made as a result of a violation of the law and were made pursuant to an order\, agreement\, settlement\, or otherwise entered into on or after Jan. 1\, 2022. Government entities must report such information to the IRS by Feb. 28th (if paper filing) or Mar. 31st (if electronically filing) of each year following the year in which the order or settlement becomes final. Government entities also have an obligation to send copies of 1098-Fs to all relevant parties by Jan. 31 of the following year in which the order or settlement becomes final. \nTherefore\, the relevant dates coming up are: \n\nJan. 31\, 2023\, for providing a copy of the 1098-F to defendant taxpayers\nFeb. 28\, 2023\, for furnishing the 1098-F reports to the IRS in paper format\nMar. 31\, 2023\, for electronically furnishing the 1098-F reports to the IRS\n\nThese changes will impact multiple divisions within attorney general offices. This discussion will focus on how to comply with these new requirements\, including: \n\nWho has to comply and what information is required\nWhat triggers the reporting requirements\nAny exceptions to reporting requirements\nHow to report to the IRS\nHow to report multiple payors and payments to multiple government entities\nDeadlines for reporting – they are coming up soon!\n\nSpeakers:\n\nJared Libet\, Assistant Deputy Attorney General\, South Carolina Attorney General’s Office\nMelissa Wright\, Section Chief\, Consumer Protection Section\, Ohio Attorney General’s Office\n\n\n\nRegistration\nThis webinar is a closed session for attorneys general and attorney general staff only. Please contact Amy Jackson with any questions at ajackson@naag.org. \nPlease submit any questions that you would like the speakers to address no later than Dec. 5 to Amy Jackson at ajackson@naag.org. The day before the webinar\, you will receive an email from Amy Jackson containing information about joining the webinar. \nCLE\nNAAG will apply for CLE for eligible attendees per CLE accrediting body guidelines. \nAccessible Event Planning\nPlease complete the Accessibility Request Form if you request accommodations for this event.

The program’s primary goal is to afford participants the opportunity to gain an understanding of and overcome the challenges when enforcing consumer protection laws. Rather\, it is designed to expose the participants to the wide and varied issues they will encounter when working on complex consumer protection investigations\, settlements\, and lawsuits. \nThe program will contain a balance of topical presentations and skills sessions on various aspects of consumer protection investigations and enforcement actions. The emphasis in both the presentations and skills sessions will be to build upon the knowledge and skills participants have\, take what they learn and apply it in the context of such cases\, and to finish the program with a better understanding of how to effectively and professionally enforce consumer protection laws. \nFaculty-led presentations will cover many topics including the beginnings of a complex case; investigations and pre-litigation discovery; victims and witnesses; common ethical issues in consumer protection matters; pretrial motions; depositions; multistate cases; negotiations; dealing with the defense; calculating civil penalties and other forms of relief; and a real-life case study. There will also be skills sessions regarding pre-trial investigations\, depositions\, negotiations\, and civil penalties/other relief utilizing a case study developed specifically for the training. \nScholarship Nominations\nNominations will be due by Friday\, August 12\, 2022. \nNAGTRI will provide a limited number of scholarships to attorney general staff to attend the training. Each office will be allowed to nominate up to three possible individuals\, however space is limited and a scholarship is not guaranteed. \nThe training will begin the morning of Tuesday\, September 20\, with registration and breakfast at 8:00 a.m. and end at approximately 1:00 p.m. on Friday\, September 23. \nContact your nominator: If you are interested in attending this conference\, click the button below and follow the instructions to contact your office’s NAAG Nominator and submit your interest. \nExpress Your Interest \nPlease contact Amy Jackson at ajackson@naag.org if you have any questions. \nCLE Credit\nNAGTRI will apply for CLE for attendees eligible under CLE accrediting body guidelines.
