SUMMARY:Ethical Hacking and State Cybercrime Laws: Legal and Policy Considerations for States
DESCRIPTION:A hacker finds a software vulnerability and tells the vendor about it. Should the hacker be prosecuted? Is this a malicious attack or a good deed? It is increasingly common for organizations to receive unsolicited vulnerability disclosures from external sources\, yet states’ cybercrime laws do not distinguish between malicious attacks and good faith security research. \nBrought to you by the Hacking Policy Council\, this webinar will discuss: \n\nThe role of independent ethical hacking in protecting cybersecurity. This will include sharing real-world experiences of good faith vulnerability disclosure mistaken for malicious crime.\nHow state laws can inadvertently criminalize ethical hacking and the policy actions taken at the state\, federal\, and international levels to avoid prosecuting good-faith security research. This will include an overview of the Department of Justice’s updated charging policies on the Computer Fraud and Abuse Act.\nFinally\, the webinar will discuss steps that state law enforcement bodies can take to distinguish ethical hackers from bad actors.\n\nModerator\n\nFaisal Sheikh\, Senior Counsel\, National Association of Attorneys General\n\nPanelists\n\nLeonard Bailey\, Head\, Computer Crime and Intellectual Property Section (CCIPS) Cybersecurity Unit and Special Counsel for National Security\, Department of Justice\nHarley Geiger\, Counsel\, Venable; Coordinator\, Hacking Policy Council\nCasey Ellis\, Founder and Chief Strategy Officer\, Bugcrowd\n\n\nRegistration Deadline: October 9\, 2024\, Noon ET\n\nThis free virtual training is a closed session for attorneys general and attorney general staff only.\n\n\nContinuing Legal Education (CLE)\n\nNAAG will apply for CLE per accrediting body guidelines upon request for attendees participating in the event.
